Hamilton's Terms and Conditions
In compliance with The Consumer Rights Act 2015, these terms and Conditions set the basis for accepting orders for goods ordered using distance communication. By ordering this way, you are deemed to have understood and accepted these terms.“Distance communication” means communication without the simultaneous physical presence of the supplier and the customer, e.g. by letters/ emails/ telephone conversations/ website orders. To avoid doubt, these terms will not apply in cases where any part of the contract has been negotiated or concluded face to face, for example, by the customer visiting the showroom. Or where the customer has inspected samples of the goods before ordering. NONE OF THE TERMS AND CONDITIONS SET OUT BELOW WILL AFFECT YOUR STATUTORY RIGHTS AS A CONSUMER.

Quotations
All quotations are generally valid for 30 days, assuming that goods are in stock and readily available. If it is subsequently found that the specification or costing includes errors, or manufacturers/suppliers, have discontinued the products, ceased with a promotion or have implemented a price increase for us, that will affect the cost of obtaining the goods and fulfilling your proposed order. In that case, the Company will endeavour to fulfil the quotation but reserve the right to withdraw the quotation without notice.
Making a purchase
The order clearly shows the products being supplied, their quantity, and their price. Where applicable, delivery and VAT are included in the final price.
Products, Offers and Sale items
They are all subject to availability and can be changed or removed without notice.
Free underlay promotion when purchasing flooring
Free Underlay with participating floor products when purchasing 15m² or more, except Kahrs, which can be 16.5m² or more, is only applicable (unless otherwise agreed in writing) when paying the online price shown on the page when you purchase. This offer only applies to free underlay products on the displayed product page. In addition, you, the purchaser, are responsible for accepting the offer at the point of purchase.
Delivery Costs
The delivery cost for small accessories is £30.00. For flooring and solid oak accessories such as door liners/frames and skirting boards, the delivery cost is £60.00. All door orders have a fixed delivery charge of £60.00 and are subject to delivery within our standard shipping areas. Deliveries are from Monday to Friday, excluding Bank holidays. All deliveries are subject to adequate access and the customer's ability to accept delivery.
Free delivery (doors are excluded)
It occurs when your order value is £2,990.00 and above. Free delivery is subject to our standard terms and conditions of trade, and the delivery address must be within our standard delivery areas. We will notify the customer if their address is outside our standard delivery areas. In addition, all free deliveries are subject to adequate access and the customer's ability to accept delivery. Otherwise, an additional cost may be incurred; we will contact you to confirm your agreement before making any payment request.
The above delivery charges are for our standard delivery areas in mainland UK but exclude all Islands, Northern Ireland, parts of Scotland, and central and north Wales. Cornwall, Devon, and Dorset.
Product Images and Product Information
All product images are only for use as a general illustration of the product type. As wood is a natural product, visual texture, grain, and colour variations are inevitable. All transactions are entered into on the understanding that the photographic image of a product is not precise and subtle differences are unavoidable. The product information and prices on this website are as accurate as possible. Still, the customer accepts that Data errors and mistakes can occur and agrees not to hold Hamiltons and any third-party updating or to maintain the website liable for any losses from relying on any details displayed on our website.
Payment
Hamiltons accept most Major UK Debit and Credit cards, GBP cheques, and bank transfer payments. The customer is responsible for any Bank transfer costs.
Tax Charges
For all orders, 20% VAT is applied to the prices on our website product pages.
Orders by way of email
Telephone and Email Orders By sending this purchase order confirmation email, we are offering to process your order on the terms contained within the email, including these terms and conditions. Once we have confirmed that the order can be fulfilled and payment has been received, a contract for the supply of goods is formed between you and Hamiltons.
Delivery & Delivery Charges
The delivery service is supplied under a separate contract, and the delivery cost is usually shown separately. For your convenience, we will give you the total amount required to provide the goods and perform the delivery service, which we will pay together. Our standard delivery charges can be viewed here. All Deliveries are to the nearest accessible kerbside, and it is the customer's responsibility to have adequate able-bodied persons available to arrange the movement of the goods from there.
Delivery Schedule
Once Hamiltons process your order, if delivery within our standard timeframe is not possible, we will inform you as to the reason why and, if possible, agree to an alternative timeframe with you or cancel the order and refund the sum paid in full.
Failed Delivery
All transactions are entered into on the understanding that the customer will be present and able to accept delivery of the products at the specified address on the delivery date. Suppose the delivery fails because the customer is absent or cannot accept delivery to the specified delivery address on the delivery date. In that case, Hamiltons may make an additional charge to cover the cost of repeat delivery. All Deliveries are to the nearest accessible kerbside, and it is the customer's responsibility to have adequate able-bodied persons available to arrange the movement of the goods from there.
Time of Essence
Hamiltons shall not be liable for losses due to not delivering at the indicated time. Time shall not be of the essence unless agreed in writing. Hamiltons are not liable for losses due to booking a tradesperson before receiving goods.
Inspection upon delivery and damages
Consumer Contracts. The customer is responsible for inspecting the goods at the time of delivery unless the goods are rejected at the point of delivery, and valid reasons for the rejection are communicated to Hamiltons. You have 14 days commencing the day after delivery to confirm in writing any damage to the products delivered. After which, it is deemed that the goods were delivered in good condition.
Business Contracts.Business contracts have 48 hours (excluding weekends and public holidays) commencing the day after delivery to confirm any damage to the products delivered in writing. After this, it is deemed that the goods were delivered in good condition.
Your right to Cancel
Subject to the conditions and exceptions below, you may cancel the contract within 14 days (the cancellation period). Unless the performance of some services, such as bespoke products, cutting specific sizes, special finishes or installation work, has begun within this period, you will lose your right to cancel. The cancellation period concerning the supply of the goods once delivered begins the day you confirm your order and ends on the expiry of the period of 14 days from the day you receive the goods. Notice of cancellation must be given in writing (by letter or email) to Hamiltons at the contact details at the bottom of this page. Once you have notified us that you want to return the goods, you have 14 days to return these goods. After which, the Company has the right to refuse returned goods.
Exceptions to the right to cancel – Special Orders and bespoke items
The right to cancel will not apply to ‘Special order" and "Bespoke items’ goods, for example, goods made to your specifications or personalized, i.e., specific cut sizes of timber sections, special finishes or products ordered explicitly on your behalf or which, because of their nature, cannot be returned. If the goods you have selected are deemed a ‘special order’, we will inform you before the order is confirmed.
Exceptions to the right to cancel – Business Contracts
The right to cancel will not apply unless the customer is a natural person acting for purposes outside his business.
Returns
In the unlikely event that you wish to return the goods. You have the right to return the goods if you notify us in writing within 14 days commencing the day after delivery. After that day of written notification, you then have 14 days to complete your return. You can return the goods to Hamiltons at your cost. The total order must be returned and received by Hamiltons in a new and unused condition and with the original packaging intact so that the goods can be resold as new. Hamiltons may, entirely at its discretion, agree to a part of the order being returned, but this must be agreed in writing with Hamiltons before returning part of the order. Unless it has been previously agreed otherwise in writing, Hamiltons will not refund part orders or returned goods not in a new and unused condition. In some instances, the company reserves the right to charge a re-stocking fee of 30% as well as delivery costs. If you require Hamiltons to recover the goods, you will be responsible for our charges, which will not exceed the direct costs of recovering the goods.

Refunds
Where possible, refunds are completed immediately. Usually, this will show on your card/bank statement within a few days, but processing times can vary between card companies and banks.
When a customer returns a part order, the original buying price will be recalculated. In cases where the initial order value entitles the customer to free delivery, but by replacing part of the order, the order's value drops to a monetary value that delivery would have been charged. The applicable delivery charge will be deducted from any refund due.
Privacy Policy
Hamiltons does not disclose customers’ information to third parties, and your personal information will never be disclosed to any other party without your express consent. If you ask, Hamiltons will occasionally email you about special offers and new products until you request that Hamiltons remove you from any list of customers. You can do this at any time by sending an email.
Cookies
Cookies are used on the shopping site to keep track of the contents of your shopping cart once you have selected an item and to store your details if you choose the 'Store your details for future purchases' option in the shopping cart.
