Terms and Conditions

Hamiltons Terms and conditions these Terms and Conditions set out the basis on which we accept orders for goods ordered by means of distance communication. By ordering in this way you are deemed to have understood and accepted these terms.“Distance communication” means communication without the simultaneous physical presence of the supplier and the customer e.g... by letters/ emails/ telephone conversations/ website orders. For the avoidance of any doubt, these terms will not apply in cases where any part of the contract has been negotiated or concluded face to face, for example by the customer visiting the showroom. Or where the customer has inspected samples of the goods prior to ordering. NONE OF THE TERMS AND CONDITIONS SET OUT BELOW WILL AFFECT YOUR STATUTORY RIGHTS AS A CONSUMER.

Quotations Quotes
All quotations are valid for 30 days on the assumption that goods are in stock and readily available to purchase. If the manufacturers have discontinued the products or have implemented a price increase to us that will affect the cost of obtaining the goods and fulfilling your proposed order the Company will endeavour to fulfil the quotation, but reserve the right to withdraw the quotation without notice.

Free underlay promotion when purchasing flooring

Free Underlay with participating flooring brands when purchasing 15m² or more except Kahrs which can be 16.5m² or more is only applicable (unless otherwise agreed in writing) when paying the online price shown on the page at the time of making your purchase. This offer is only applicable to products offering free underlay on the actual product page displayed. In addition, it is you the purchaser who is responsible for accepting the offer at the point of purchase.

Delivery Costs
For small accessories, the delivery cost is £28.00 inclusive of vat. For flooring and solid oak accessories such as door liners/frames and skirting boards, the delivery cost is £54.00 inclusive of vat. Free delivery (doors are excluded) is when your order value is £840.00 inclusive of VAT excluding delivery cost. Free delivery is subject to our standard terms and conditions of trade and the delivery address is within our standard delivery areas and our normal delivery dates. We will notify the customer if their address is outside of our standard delivery area. All door orders have a delivery charge of £54.00 inclusive of vat. The delivery charge is for standard areas inside mainland UK but excludes Northern Scotland, Remote areas of Wales and some areas of Cornwall and Devon. 

Product Images and Product Information
All product images are for use as a general illustration of the product type only. As wood is a natural product, visual variations in texture, grain, and colour are inevitable. All transactions are entered into on the understanding that the photographic image of a product is not precise and subtle differences are inevitable. The product information and prices on this website are as accurate as possible but the customer accepts that Data errors and mistakes can occur, and agrees not to hold Hamiltons and any third party updating or maintaining the website liable for any losses arising as a result of relying on any details displayed on our website.

Hamiltons accept most Major UK Debit and Credit cards GBP cheques. Bank transfer payments. The customer is responsible for any Bank transfer costs.

Tax Charges
For all orders, 20 % VAT will be applied to the prices displayed on our website product pages. Customers in countries outside the European Union should email or telephone to make alternative arrangements.

Credit Card Security
All credit card numbers are stored safely and once the transaction has been completed they are shredded. Telephone and Email Orders By sending this purchase order confirmation email, this is an offer to process your order on the terms contained within the email, including these terms and conditions. A contract for the supply of goods is formed between you and Hamiltons once we have confirmed the order can be fulfilled and payment has been received.

Delivery & Delivery Charges
The delivery service is being supplied under a separate contract and the Delivery cost is normally shown separately. For your convenience, we will on occasion give you a total amount required in respect of supplying the goods and performing the delivery service which can be paid together. Our standard delivery charges can be viewedhere 

Delivery Schedule
Once Hamiltons process your order. If delivery within our standard timeframe is not possible we shall inform you as to the reason why and if possible agree to an alternative timeframe with you, or cancel the order and refund the sum paid in full.

Time of Essence
Hamiltons shall not be liable for any losses as a result of not delivering at the indicated time. Time shall not be of the essence unless agreed in writing. 
Hamiltons are not liable for any losses as a result of booking a tradesperson before receiving goods.

Failed Delivery
All transactions are entered into on the understanding that the customer will be present and able to accept delivery of the products at the specified address on the date of delivery. If the delivery fails because the customer is not present or is unable to accept delivery to the specified delivery address on the date of delivery an additional charge may be made by Hamiltons to cover the cost of repeat delivery. All Deliveries are to the nearest accessible kerbside and it is the customer's responsibility to have adequate able-bodied persons available to arrange the movement of the goods from there.

Inspection upon delivery
It is the customer’s responsibility to inspect the goods at the time of delivery. Unless the goods are rejected at the point of delivery, and valid reasons for the rejection are communicated to Hamiltons, the customer will be deemed to have accepted the goods and confirmed that they are in good condition when delivered.

Your right to Cancel
Subject to the conditions and exceptions below, you may cancel the contract within 14 days (the cancellation period).  Unless i
f the performance of some services such as cutting specific sizes, special finishes or installation work has begun within this period you will lose your right to cancel. The cancellation period in relation to the supply of the goods once delivered begins with the day you confirm your order and ends on the expiry of the period of 14 days from the day you receive the goods. Notice of cancellation must be given in writing (whether by letter, fax or email) to Hamiltons at the contact details found at the bottom of this page. Once you have notified us that you want to return the goods you have 14 days to return the goods.

In the unlikely event that you wish to return the goods. You can return the goods back to Hamiltons at your cost. The full order must be returned and received by Hamiltons in a new and unused condition and in the original packaging. Hamiltons may, entirely at its own discretion, agree to a part of the order being returned but this must be agreed in writing with Hamiltons prior to returning part of the order. Unless it has been previously agreed otherwise in writing, Hamiltons will not refund part orders or returned goods that are not in a new and unused condition. In some instances, the company reserves the right to charge a re-stocking fee of 25% to cover costs incurred. In the event that you require Hamiltons to recover the goods, you will be responsible for our charges not exceeding the direct costs of recovering the goods. 

Exceptions to the right to cancel – Special Orders and bespoke items
The right to cancel will not apply in relation to goods that are ‘special order’ for example goods that are made to your specifications, or personalized, i.e. specific cut sizes of timber sections, special finishes or products specifically ordered on your behalf, or which by reason of their nature cannot be returned. If goods you have selected are deemed to be ‘special order’ we will make you aware of this before the order is confirmed.

Exceptions to the right to cancel – Business Contracts
The right to cancel will not apply unless the customer is a natural person acting for purposes that are outside his business.

Privacy Policy
Hamiltons do not disclose customers’ information to third parties and your personal information will never be disclosed to any other party without your express consent. If you ask, Hamiltons will advise you by email about special offers and new products from time to time until you request that Hamiltons remove you from any list of customers so electing. You can do this at any time by sending an email.

Cookies are used on the shopping site to keep track of the contents of your shopping cart once you have selected an item and to store your details if you select the 'Store your details for future purchases' option in the shopping cart.
